@jshm2 A case could be made that the constitution does not cover this issue and that the President is the ultimate recipient of the classified documents. Therefore he should be able to retain them in his possession as long as he is President in order to refer to them so that he can make the appropriate decisions.

Of course, when Carter signed the bill into law in 1980 he effectively hobbled all future Presidents. So, the question involves the constitutionality of the law. Does it compromise the President's constitutional powers?

@jshm2 He was the Vice President when he stole the documents. VPs have no such power.
@redredred Did he “steal” them or was it a wink, wink, nudge, nudge, ( here, Joe, take these)based on activity during the Obama/ Biden administration? Those documents didn’t simply miracle themselves to at least 3 different locations.

@soar2newhighs I have no idea but a Vice President has no more rights to classified documents than I do.
@redredred 2 days ago his “ aides” found a few pages of documents. I’m confused: his aides are looking for documents? Why isn’t the FBI or people from the National archives under the supervision of the DOJ searching?
@jshm2 If what you say is true, why should this even be an issue at all?
Were these documents moved from the WH to the three locations while he is holding office as president or removed when he was the VP?
