pretty sure the law prescribes the bandwith of applicable punishments. so as a judge I would follow that guidance. as a democratic society that is how laws are set and justice is provided

@KA9ha Recidivism is common for rape offences, hence the original imposed sentence should be higher - 5 years is simply a starting point of sentencing available to the judge
