They have an ethnicity....but their ethnicity is not the same as their Nationality.
My Nationality is American (I was born in New York as a child of American citizens).
Ethnically, I’m a mutt....predominantly of European descent (Irish, Italian, Greek, Spanish), but also of African, Middle Eastern and Southeast Asian ancestry.

Are we speaking in legal of realistic terms?

If you were born in America you are an American before all else. I am an American with Irish heritage. So called African Americans are actually Americans with African heritage and so on and so forth.

Ethnicity, however, refers to cultural factors, including nationality, regional culture, ancestry, and language.

Someone can still have ancestry and culture from another location. You can be Irish American for example.

African Americans are a unique case, as their indigenous cultures were stolen from them, so they created a new one.
