Is it illegal to text an employee after work hours?

I keep getting texts about work related things but at night last one was at 11:30 at night and it's in a group chat to. My boyfriend thinks it's illegal and I think so to. But I'm not sure.

I live in California if other states are different.

I can’t imagine my manager texting me that late but I don’t think it’s illegal unless it’s harassment or something like that.

If you're an hourly employee they are required to pay you for that time.
Put phone on silent or turn it off. Check your company policy.

I think you should be fired. Problem solved.

ignore the texts.

If you are non-exempt, then they can not text you after you clocked out. Or they'll have to pay you. Especially on your own cell phone.

Don't know about us. in UK it is illegal unless you've agreed to it as part of your contract, i would start there!

California has some of the strongest laws protecting employees so it very well might be.
SW-User

@FelixLegion for verbal assault or threat?

If you answer work related questions in your own time claim overtime.

I know it's not illegal in Illinois and I'm pretty sure it's not illegal anywhere. If it's causing a problem you may need to talk to your employer about boundaries or your boyfriend about being less sensitive. they're texts right? That means you can just ignore them till it's convenient to deal with them.

It is illegal in California. They aren’t even supposed to talk about Work when you are on lunch or break
SW-User
@MethDozer It's also wrong lol.
newtomountainlife · 56-60, M
@MethDozer I know! We had to sign a paper saying we wouldn’t talk to anybody during our breaks or lunch about work 😳
SW-User
@newtomountainlife That's because state law requires certain breaks. Lunch tends to be unpaid. Therefore, you should be doing no work when on lunch.
SW-User
It's not illegal lol. It's part of having certain jobs. They'll have to learn to wait.

Illegal? Hahahaha
It's not illegal in the U.K. I used to have a separate work phone which I'd switch off at 6.30pm
SW-User
@InOtterWords yes I left mine at home tonight 😂😂
@SW-User check your settings but it's there. Or speak. To someone in Networks they would know 😝
SW-User
@InOtterWords I'm teasing I know they can be switched off I'm just sorting out a few things and I'll order a new one.

Generally no, nor should it be. Then again you mention living in California so anything bat-shit is possible there.
SW-User
@MethDozer bollocks. If you're paid fixed hours, outside of them fk work!

@SW-User Cry me a river. Sometimes a question needs to be asked. Welcome to life.

@SW-User It's after hours...at 11:30 at night. Some times even 1am. The building closes at 8pm
