@Blueberries So then rape would be hard to prove, particularly if you'd just had complicit and consenting sex and you made no particular show of withdrawing consent. It is not necessary under law to gain explicit consent before every sexual act. It can be reasonably assumed that consent is there in certain circumstances.

@Blueberries It all starts with you. If you feel that it was rape then you have a right under the law to pursue charges and a conviction. Just be sure that you are being reasonable because the law focuses a lot on what reasonable people would think and do in a given situation. No man is a mind reader, or woman for that matter. If a woman were to grab her husband as soon as he walks in the door and start touching him intimately, he could claim sexual assault if verbal consent was a legal requirement. What he can do though is to communicate. If he doesn't want it at that time, for any reason, then he can say no. This obviously changes if threat is employed to ensure consent, but that is where the actions of a reasonable person come into play. A reasonable person wouldn't assume that sex under threat is necessarily complicit.
