Trump will be resoundingly defeated in court if he declares a national emergency (because there is none).

1) None of his claims of a crisis hold up to any scrutiny.

2) Congress is in session.

3) He hasn't finished using the money available for fencing.

4) The humanitarian issues at the border are Trump's own making.

The government will still need to be re-open!

He will be weaker than ever after being struck down, and Republicans will be on record for supporting giving the President tyrannical powers and abdicating their role in Congress.
Check out what one federal judge has already said about this:
In a ruling denying the government’s bid for more time, U.S. District Judge William G. Young said lapses in federal appropriations, like the current one triggered by President Donald Trump’s demand for funding for a border wall with Mexico, aren’t a government “policy” that could theoretically justify staying such a lawsuit.

“Let us talk plain -- they are simply an abdication by the president and the Congress (which could override a presidential veto) of the duty to govern responsibly to the end that all the laws may be faithfully executed,” Young said in the Jan. 2 ruling in San Juan. “Nor does such a lapse in any way excuse this court from exercising its own constitutional functions.“

Young, who is based in the Boston federal court but sitting in San Juan as a visiting judge, sarcastically compared the situation to a major corporation that “for whatever reason” decided not to pay its attorneys involved in pending litigation and instructed them not to interact with the court.

“Then the corporation says to the court, ‘We greatly regret any disruptions caused to the court and to other litigants, but please stay all proceedings until we get our act together.’ This does not constitute ‘good cause’ for any stay,” Young wrote. “In fact, it is laughable.“
There is also legal precedent. President Truman tried to seize control of steel mills that were on strike as a national emergency. The Supreme Court denied his actions. That was much more a crisis than Trump's manufactured crisis, and will almost certainly be struck down if he attempts it.

@windinhishair Good point. I wonder if Trump will be stupid enough to use the Court holding-up FDR's internment camps as precedent.

@SW-User Nothing, absolutely nothing, would surprise me any more.
@SW-User It probably is the case most on point, and invoking it send a signal to his base.

@Budwick Yes we do!!

Oh, wait... Except that migrant crossings are at a historical low.

Except that illegal drugs come through legal ports of entry, not over the border where it's unsecured.

Except that the number of children smuggled over for illicit purposes last year can be counted on two hands.

Except that the number of suspected terrorist detained at the border last year can be counted on one hand.

Yeah, a real crisis.

@Budwick no, far from exaggeration, these are actual statistics. You can look up the definition for that on your own time.

As for how many crimes are acceptable, why not take a look at those committed by natural born citizens? If you can get through those, you can finish up with a fraction of that number committed by illegal immigrants.

And please, let me make this easier for you. The world is not binary. This issue is not binary. It's not a question a 30 foot wall or nothing but open borders. It's a question of effective, affordable and long-term security measures, and there are many from which to choose. You know, the kinds of things that take us into the future in a progressive way. While Trump is touting "walls and wheels" as technology that never dies, the self-same "king of technology" needs to begin to look it actually effective measures to control immigration.

And they don't start with simply keeping people out. They start with international relations and policies. But I'm sure I'm over your head by now.
