'Devastating': Supreme Court blows massive hole in state gun control efforts

In a decision with sweeping and grave implications for gun control laws across the country, the right-wing U.S. Supreme Court on Thursday struck down New York state's restrictions on the concealed carry of firearms in public.


Slate legal reporter Mark Joseph Stern warned that the high court's 6-3 decision—penned by Justice Clarence Thomas—"goes so, so far beyond concealed carry."

"It's difficult to overstate how devastating Thomas' opinion is for gun control laws," Stern wrote. "The Supreme Court has effectively rendered gun restrictions presumptively unconstitutional. This is a revolution in Second Amendment law."

The ruling in the case, officially titled New York State Rifle & Pistol Association Inc. v. Bruen, comes in the wake of horrific mass shootings in Uvalde, Texas and Buffalo, New York.

The now-invalidated New York law required applicants for a concealed-carry permit to demonstrate "proper cause" and "good moral character" before gaining state approval. The Supreme Court's right-wing majority deemed those requirements a violation of the Second Amendment.

Several other states—including California, Hawaii, Maryland, and Massachusetts—have similar laws.


"This is devastating," Democratic New York State Sen. Alessandra Biaggi tweeted in response to the ruling. "Expand the Supreme Court."

@Spunkylama Once they realize it'll have to apply to all the people they're trying to rob power from, they may reconsider. Then again, maybe they really are just hoping most of us kill each other and take the work off their hands.
@Graylight It only take a few crazy people attacking their families and they will feel very different about it. The violence is ramping up and the more they anger people the more likely someone will act out on that violence. Reap what you sow...

@WalksWith No that's wrong. Two separate subjects governed by different statutes and laws.
@WalksWith Women need to make sure they get themselves AR15's and use the stand your ground law. If you feel threatened as a pregnant woman you are allowed to shoot them.

Gonna be very weird if Supreme Court ends a constitutional right to obtain an abortion next week, saying it should be left to the States to decide, right after it just imposed a constitutional right to concealed carry of firearms, saying it cannot be left to the States to decide

@SW-User Oh, yours seems a much better system. Not infallible, I'm sure, but as I say, this selection process seems to be flawed and therefor can't yield the best outcome for any side. Hmmm.

@Graylight having worked with inmates the past 32 years, I can tell you that they arent concerned in the least bit with gun laws. They are not a deterrent in the least. But, what do I know, I've only been working in the legal system for three decades. I would say though that the penalty for committing a crime for a firearm should be much worse than it is now. If you hit violent offenders with a very lengthy sentence, if nothing else, you can keep them off the street.

I don't have any argument over gun laws. This nation needs fewer guns, period; at least temporarily. All evidence and data suggest this. And countries [i]can[/i] transition from a gun culture to a gun-free country; all evidence and data suggest this. And no, the US is no different in any fundamental way that imbues it with magical defiance of proven history; all evidence and data suggest this.
