Don't quote me on this but I think it has to be expressed through a signed waiver. I used to work as a wilderness guide in Tennessee and we made clients sign them before we would take them anywhere so we wouldn't be liable for accidents.

@SwampFlower Thanks for your reply: I just saw it. I've signed that kind of waiver in the past but I suspect it wouldn't hold up if negligence can be shown; also wonder about the value (legally) of the 'Enter at your own risk' types of sign. Ah, the subject's too big - need a specific case to argue over :).
