Anyone file whiplash injury claim?

With a lawyer?

I'll be hopefully putting in my whiplash claim from a December 2024 accident soon. The thing is besides physical symptoms that I treated with chiropractor, I have anxiety in car now fearing someone will rear end me again. I'll even yell STOP many times because more time than not people apply the brakes at last minute .


So my lawyer said to claim Pain and suffering, the mental aspect, I'd need therapist to write for me about my fears. I asked her couple months ago and she kind of shot it down, saying PTSD was hard to prove and to 'just do the physical symptoms '. I'm going to ask once more though because it wasn't only physical. Anyone have experience with getting a therapist to back you, for a claim?

Yes but not through a lawyer. I also had broken sternum and broken teeth

I have processed many whiplash and other personal injury claims working in a lawyers office for clients

Keep on your therapist for that letter and if you have to, get your lawyer to contact her for the letter. Sometimes the lawyer can give a little push and then she’ll realize that OK yeah she needs to do that. Who the F is she to tell you to just pursue the physical claim and not the mental one?

And having had all that experience processing claims at work, I can tell you that 100% have claimed pain and suffering, mental anguish, loss joy etc.

The anxiety takes a while to subside but it eventually does

@Jenny1234 Thank you I appreciate your feedback. Yeah it's weird and Also frustrating...she shot down my chronic regular PTSD too, when I said I wanted to apply disability AND work too, (you can do both). She's like 'You talk regular. You'd have to be nearly nonverbal to be approved.' wth???? No you don't need to be nonverbal. Yes it's tough to be approved but don't dismiss my condition.

I will ask again, thank you friend. Will they accept a family member words on your mental state,? My sister has seen me first hand yelling in fear that I'll be hit. 😧

@Coralmist I think your sister should definitely write a letter of support to your lawyer

I’m not sure why your therapist is so unsupportive
