Well I think this hinges on whether they were actually classified or not - this sounds like it's going to be a retrospective withdrawal of the presidents power to classify/declassify documents - I wouldn't be surprised if it goes to supreme court to rule that presidents have never been allowed to do this and therefore he couldn't have done it. Of course they won't go after former presidents who have similar "declassified" documents. Or former secretaries of state who kept classified documents electronically on an email server in their house.
