If you don't pay a prostitute, is it rape or theft?

I would just call it being cheap. It would be theft of service, but the service is illegal. I wouldn't try to make a habit of it though. A friend of my son hired a prostitute and didn't pay her, seems she has friends or works directly for a gang member, they hunted him down and beat the hell out of him a few days later.
