Yes but my point is if Obama didn’t violate the constitution. Neither did Trump. They should of thought before they passed a bill giving the president national emergency powers. President Trump had the power to do it and he did.@WoodyAq

This is a grotesque misuse of emergency powers. They were clearly meant to give the president flexibility when timelines were too short for Congress to act.

It is explicitly [b]not[/b] intended for POTUS to do an end run around Congress after they have acted.

@marriedplus3 Arguably they never did, and the courts have ample cause to strike it down.

If the courts refuse to act, then yes, the Congress will have to more explicitly rule out obvious abuses.

I don’t think the Supreme Court will strike it down. Why? Because as long as drugs are coming here human trafficking is happening and previous presidents called it a emergency. I think the surpreme court rules in Trumps favor @WoodyAq

@marriedplus3 The situation at the border hasn't changed for years. Congress has had ample time to discuss the issue, and has, and has arrived at a conclusion.

So, clearly not an emergency in the sense that the Congress intended for the legislation. And thus, unconstitutional.

The constitution says that's the end of the story.
