Just had baby, Husband fired from job today

So we just had a baby 5 and a half months ago. Husband has been at his job for over 10 years and is supposedly a top performer (by the numbers).They fired him not for missing necessarily but for not giving enough notice. They wanted 2 weeks notice everytime. But when you have a baby and they are sick.. I mean that isnt possible. He still had a week of PTO left even.. Everytime he missed it was for doctor's appointments for the baby and to stay home with her when she was sick. I work full time too, but do not make enough to cover our rent by myself and other bills. Im freaking out.. He is SO depressed and im worried sick. They are refusing severance.. I dont know if he will get unemployment..He says they never gave him any formal warning about how not giving enough notice could result in losing his job. Please ANYONE.. Have you been in this situation? please share how you go through this. Advice? help help help

Depending where you live, it sounds like you would probably have legal redress - get him to go see a labor lawyer as soon as he can, force them to at least reconsider severance (at a bare minimum).

He lost his job... He can get a new one. Even if you ran completely out of money... You can go bankrupt, and get aid from the state. Even if your worst nightmare came true... You would be okay, 'cause it's human nature to persist through struggle, and try to survive. The sun's still gonna rise and set on every new day.

Do what you can. Be there for your baby. Try to keep stress levels at a minimum, if it all possible--for you, for the baby, for your husband. Life is like this... Throws the unexpected at us when we think we've got everything figured out.

I wish you well on your journey, and hope things turn around really soon. Enjoy your new gift of life as much as you can. It's hard right now, but it'll swing the other way again. It always does.

What kind of support can you get right now?

He may be penalized for being fired but still able to draw unemployment
Here they make you do job search's and take classes so your not just sitting home saying you can't find a job ,
But my ex was fired over to many absences in a 90 day period (She was rehired )
But all of them had a doctors excuse ,they found she was wrongfully terminated and she got her back pay and I think her insurance stayed in force .
But she did finally get paid .
They rehired her again ,,then I let her just quit
They did not treat employees right
Look into Children and Families as well ,see what assistance they can give you

Wow. That's shitty. I'm sorry.
Apply for WIC and food stamps. I know it's a hard thing to do, when you pride yourself on being self-sufficient, but that's exactly what those programs are meant for. Not for lazy assholes, but people hitting hard times.

also, it really depends on your state but here they could fire you for any reason without any formal warning. You might want to check your labor laws there. Also you might want to look into FMLA, thats is exactly what its for.

Talk to an experienced labor attorney. This could fall under FMLA and his termination may not be within the guidelines of the statute. The size of the employer comes into play with respect to application of the law, where small businesses, and you have to abide by employer leave policies, and may have to assert FMLA status when requesting leave. It sounds like he was fired on a technicality and an appeal through an attorney may have merit to reinstate him. Talk to a couple of attorneys to see if there’s any legal redress of the issue.

Depends on the state you live in but most states are at-will states where employers don't need a reason to terminate unless there is some sort of employment contract so odds are that severance is out of the question. As far as unemployment goes he needs to get out there and apply. Doesn't sound like he was fired for any kind of illegal act but it can be a bit case by case as far as breaches of company policies go.

Consult a lawyer. You may have some legal recourse, but it depends on the labor laws where you live. In most states, workers are employed at will unless they have a specific contract, meaning that employers can terminate employment for any reason at any time.

Contact corporate office. Nobody should be fired like that. Family comes first. And especially if he had PTO, he shouldn't have been fired.

@Brassm0nk3y I misunderstood then...I was under the impression he made more. However, this should be a written policy. He has no excuse for not knowing the policies surrounding time off. I take the time off because my husbands job is more important. Him calling out constantly would be a red flag and ..that is just common sense. You should have taken time off too..did you not?

@JaggedLittlePill do not get me wrong...you may have a case for unemployment at the very least but it seems if the time was excessive and this was a written policy there may be no way to fight it at all.
