Exclude Illegal Aliens From Census?

The Supreme Court on Friday agreed to review a Trump administration effort to exclude illegal aliens from the 2020 census count that is used to apportion congressional seats.

In an unsigned order the justices set a Nov. 30 date to hear oral arguments from the parties.

A three-judge panel in a New York district court in September ruled that Trump’s memorandum excluding illegal aliens from congressional apportionment count was an illegal overreach of the president’s authority as delegated by Congress. The judges on that panel declared the memo, which was issued on July 21, as unlawful and subsequently blocked it from being implemented.

It boils down to this; should people in the US illegally be counted in the census for the purpose of the reapportionment of Congress members following the 2020 census.

What do you think?

Who is in charge of entry into the United States?

The feds or the States.

When that light bulb goes off in your head you'll then realize that illegal entry causes problems for some States and for others not so much.

But it should be a FEDERAL responsibility to deal with the problem.

And since Nebraskans don't have do deal with the problem of illegal immigration so much, but Texas does, then the States that do have to deal with the problem get proper representative for the whole number of PEOPLE in their State, giving them proper clout for everything for funding highways to federal prosecutors, FBI offices, more border security, health care, education, etc.

You want a list of people raped, murdered or killed in a car by drunken illegals - in NEBRASKA?

We are the United States. Entry to OUR country is controlled by the federal government - of course California has decided on their own to ignore law and order. And, people throughout the whole country are paying the price.

Should I surmise from your comment that your expectation of the Supreme Court would be to ignore the law as written? Or, re-write it? If so, you will have a better understanding of why appointing someone like Barret is so very important!
@Budwick You are ignoring the highest law of the land, as written.

If you respect the Constitution & the Founders, and are a strict constructionist, you have to read its plain meaning.

The meaning of "person" is plain. It is not the same as "citizen". Read Madison's notes on the convention for more insight.

I would expect SCOUTUS will say "persons" means "persons", not "persons except those here illegally."

@SomeMichGuy I see.
So we should count,... visitors from France that happen to be in country during the census?
@Budwick lol

Check out 13 USC Sec. 141.

It is a "census of population", a term of art defined at 13 USC Sec. 141(g).

Population...as of 1 April.

You can use a dictionary to look at population & inhabitant, but the notion does not include people visiting on vacation. People with an address are intended to be counted, and residents without a fixed address ("homeless") have been counted as best can be done.

But you can type and intake visual information when encoded in linguistic symbolic notation, so go use Google yourself and waste your own time, troll.

@SomeMichGuy Be sure to bring this documentation with you to the Supreme Court.
@Budwick Just go read, troll.
