Do you believe a homeowner should be charged for murder if he or she uses lethal force on a home invader.

There have been cases where the family of a perpetrator will demand legal action against someone who injured or killed their family member who broke into the home in the first place.

Do think this makes any sense?

Nope, you break in, you get shot.

It makes zero sense that a home invader can sue you for injuring them or their family suing if you killed their family member. My state passed a law protecting property owners from legal retribution, either criminal charges or being sued in civil court if the police and district attorney find you were acting in good faith to protect yourself or your family/anyone else you have in your house/apartment from the perpetrator. Castle Doctrine.

The ability for a person to defend their home is of utmost importance.

Hell no...blow the bastards head off.

The home is a very private place. Anyone who invades it deserves their body invaded by a bullet or 2 or 3 or 4, etc in return.

With regards to the homeowner charged for murder, that law equally deserves bullets and holes.
No, it makes no sense whatsoever. The law talks about ‘reasonable expectation of privacy.’

Someone breaking into somebody else’s house has no ‘reasonable expectation’ of safety. Or walking out in one piece.

[c=#7700B2]nope, that is self defence as far as I am concerned [/c]

No.Here in England even the Prime Minister has said if anyone chooses to break into a home they leave their legal rights outside.

@Stereoguy No.It was a response to an intruder getting killed by a house owner several years ago.

I think if you break into my home, I'm gonna do what I gotta do to get you out.
I think homeowners should only be allowed to empty two magazines into a home intruder ao as not to disturb the neighbours - unless, of course, they can suitably muffle the sound.

@EugenieLaBorgia Two mags might be excessive. I have a number of fire arms but m personal defense is my Glock 19 which holds 15+1 rounds per mag.

My home defense is my Windham AR-15 which holds 30+1 rounds per mag.

As for silencers that’s a while other can of worms and legal work.
@TakingBackMidgard Those AR-15's are very nice. I think more people should own them.

@TakingBackMidgard If I miss with this the noise alone will scare him to death.....

I think murdering someone for trying to steal a TV is a little excessive, yeah. Self-defense notwithstanding.

@abe182 Eh I just keep a dog. Burglars stay away, and I don't have to have power fantasies about killing people.
abe182 · 46-50, M
@CountScrofula I have hamsters and no fantasies about killing people.

It absolutely depends on the situation, and what is happening. If the homeowner has a credible reason to feel like they're in serious danger, no. And that can stretch a long ways.

But if the dude thought nobody was home, isn't armed, and is, say - on his knees with his hands up, you don't get to execute people for attempted stealing.
@DestroyerOfIdeologies if you want food from me - you ask me during the day - you come into my house at night - I have a sushi knife that is dying to fillet someone's ass at 4 in the AM
QuixoticSoul · 41-45, M
@DestroyerOfIdeologies That sounds like a situation where deadly force was completely warranted.

@sunsporter1649 Goddamn, stop it with the aggressive stupidity 🙄
sunsporter1649 · 70-79, M
@QuixoticSoul Maybe you can throw petunias at them, that will get their attention
The tough cases, even in states with shoot the burglar laws are where burglars get shot in the back or out in the yard trying to escape the homeowner.
@sunsporter1649 that's one problem. The other is when homeowners shoot kids.

I'm not a big fan of shoot the burglar laws myself. I just could never get my head around killing in defense of property, and it seems to me like if it's not self defense, it shouldn't be excused just because the victim was a trespasser.
sunsporter1649 · 70-79, M
@MistyCee That is easy to discuss two months later, in a court room, not at the moment of contact
@sunsporter1649 I get it, and it seems like it's most often a scared old man shooting at a 12 year old kid who looked much bigger and scarier when he was alive.

I've actually got a piece of a civil case right now where a homeowner fired 41 "warning shots" at a utility guy in his driveway.. Nobody got hurt, but he mouthed off to the cops who arrested him, and now he's suing the utility company and the sheriff's department pro se for intentional infliction of emotional distress.
If the intruder has holes in his back I’d expect a few Qs asked..
sunsporter1649 · 70-79, M
@TheOneyouwerewarnedabout Figures you would be in the opposition

I don’t see the point on killing someone running away.. I’d not Q a body riddled with bullets in the their front side.. @sunsporter1649

Now that's funny.
